Terms and Conditions

Private guided cycling tours and related experiences

Effective from: 20 July 2026

1. Purpose and scope

These Terms and Conditions govern the booking and provision of guided cycling tours and related services offered by JAE, športne dejavnosti, d.o.o. (hereinafter: JAE). By confirming a booking, the customer confirms that they have read, understood and accepted these terms. The terms apply to consumers and, where appropriate, to other customers.

Important: cycling is an activity involving increased risk. JAE provides professional preparation and guiding, but cannot eliminate all risks connected with traffic, terrain, weather, physical exertion and the conduct of other persons.

3. Services and pre-booking information

JAE offers private guided cycling tours of different lengths and difficulty levels. Descriptions of routes, duration, distance, elevation gain and anticipated time are indicative. Actual delivery depends on the abilities of the group, weather and traffic conditions, closures, road works and other safety factors.

The price and scope of the included service are stated in the offer or booking confirmation.

Where a bicycle, helmet or other equipment is included, the Rental Bike and Equipment Terms also apply.

Before confirmation, the customer must provide accurate information about the number of participants, experience, physical fitness, height and any special circumstances relevant to safety.

4. Booking and conclusion of the contract

An enquiry does not itself constitute a booking. The contract is concluded when JAE confirms the date in writing and receives the agreed deposit, unless expressly agreed otherwise in the offer. Before confirmation, JAE may request additional information in order to select an appropriate tour, equipment or guide.

A customer booking for a group warrants that they are authorised to provide the other participants’ details and will inform them of the terms, safety instructions and obligations.

5. Price, deposit and payment

A deposit of 30% is normally required to confirm a booking.

The balance must be paid no later than before the start of the tour, by bank transfer or in cash.

The booking becomes final upon receipt of the deposit or under another written arrangement.

Any extras, such as a particular type of bicycle, additional equipment, transport or individual requirements, are charged in accordance with the offer.

If payment is not made within the agreed period, JAE may cancel the booking after prior notice.

JAE is not a VAT payer. VAT is not charged in accordance with Article 94 of the Slovenian VAT Act (ZDDV-1).

6. Cancellation by the customer

Cancellation must be submitted in writing to JAE’s email address. The cancellation time is the time at which JAE receives the message.

7. Booking changes and transfer to another person

JAE will make reasonable efforts to allow a change of date, but this cannot be guaranteed. A change is valid only after written confirmation by JAE. The customer may propose a substitute participant if that person meets the safety and other requirements and suitable equipment and sizes are available.

8. Weather, safety and cancellation by JAE

JAE or the guide decides whether the tour can be conducted safely. Rain alone does not necessarily mean cancellation. If JAE considers that delivery is unsafe or unreasonable, it will first offer another date, another route or a comparable solution. If suitable rescheduling is not possible and JAE cancels the tour, payment for the unperformed part of the service will be refunded.

JAE may change the route, direction, length, pace, start time or included stops due to weather, group ability, closures, congestion, road works, traffic accidents, trail conditions or other circumstances. A reasonable safety adjustment does not constitute non-performance of the contract.

9. Late arrival and non-attendance

The participant must arrive at the meeting point at the agreed time. In the event of expected delay, JAE must be notified immediately. For the safety and convenience of the group, the guide may start the tour without a late participant. A delay of more than 15 minutes without notice may be treated as non-attendance without entitlement to a refund.

10. Health, fitness and risks

Each participant must realistically assess their health, fitness and ability to ride safely. Before the start, the participant must disclose health circumstances, allergies, injuries or other factors that could affect safety where such disclosure is necessary for safe delivery. JAE does not conduct medical examinations and gives no medical assurances.

11. Children and minors

A minor may participate only with the consent and under the responsibility of a parent or legal guardian. A child must be able to ride independently and safely, use a correctly sized bicycle and be prepared for the selected route. JAE or the guide has the final decision on suitability before or during the tour.

12. Safety rules

A helmet is mandatory throughout the ride.

The participant must comply with road traffic rules, the guide’s instructions and a safe following distance.

Use of a telephone while riding is permitted only when safe and lawful.

The guide may refuse or terminate the participation of a person under the influence of alcohol, drugs or other psychoactive substances, or a person who endangers themselves or others. Continuing contrary to the guide’s instructions is at the participant’s own responsibility and may result in exclusion without refund.

13. Own bicycle and rented bicycle

A participant using their own bicycle is responsible for its technical condition, suitability for the route and required equipment. JAE may refuse the use of a bicycle that is clearly unsuitable or unsafe. Separate terms apply to rented equipment. A participant is not responsible for normal mechanical failure or wear; damage caused intentionally, by gross negligence, by failure to follow instructions or by improper use may be charged at actual reasonable cost.

14. Photography and filming

JAE may take photographs or video during the tour. Identifiable images of participants are used for promotional purposes only on the basis of voluntary, specific and withdrawable consent. Refusal does not affect delivery of the service. Images needed to document damage, a safety incident or legal claims may be processed on another appropriate legal basis.

15. Liability and insurance

JAE is liable for damage in accordance with mandatory law. No provision excludes liability that cannot legally be excluded, particularly liability for wilful misconduct or gross negligence. The participant accepts the ordinary and foreseeable risks of cycling and is responsible for damage caused intentionally or negligently.

Participants are advised to obtain their own accident, health and liability insurance covering cycling activities in Slovenia, Italy and Austria. JAE is not responsible for loss or theft of personal belongings unless the loss results from JAE’s proven responsibility.

16. Force majeure

JAE is not liable for non-performance or delay caused by circumstances it could not reasonably foresee or prevent at the time of contracting, including natural disasters, extreme weather, fire, epidemics, area closures, measures by public authorities, major traffic disruption or comparable circumstances. The parties will seek rescheduling or a fair solution for the unperformed part.

17. Complaints

A complaint may be sent to info@julianalpsexperience.com. JAE will handle it without undue delay and aims to reply normally within eight working days. The consumer must allow reasonable verification of the circumstances and provide the information needed to consider the complaint.

18. Alternative dispute resolution

JAE currently does not recognise any provider of alternative dispute resolution for consumer disputes as competent to resolve a consumer dispute, unless it later decides otherwise or mandatory law requires it. Information on any change will be published on the website and in the applicable terms.

19. Applicable law and jurisdiction

The contractual relationship is governed by the law of the Republic of Slovenia, while a consumer retains the protection granted by mandatory provisions of the country of their habitual residence where those provisions apply. The parties will first seek an amicable solution; otherwise, the court with jurisdiction under the applicable rules will be competent.

20. Final provisions

If an individual provision is invalid, this does not affect the validity of the remaining provisions. A solution closest to the purpose of the provision and consistent with law will apply. JAE may amend the terms for future bookings. The terms made available to the customer at the time of booking confirmation apply to that booking, unless a later amendment is more favourable to the customer or required by law.
